AOBA Opposes MD Eviction Fee Surcharge
AOBA joined the Maryland Multi-Housing Association in opposing state legislation that would impose a $3 surcharge on each summary ejectment case filed in Maryland District Court, effective July 1, 2015. HB 54 was introduced at the request of the Maryland Judiciary for the purpose of funding automation of court records and development of an electronic case filing system.
AOBA testified that increasing court costs for tenants facing eviction by $1.6 million annually was a poor method for funding court automation. Additionally, as the District Court’s electronic filing system is not currently capable of accepting bulk filings of summary ejectment cases, rental housing providers and tenants would be paying a surcharge for a system that they cannot use. The bill is pending in the Maryland Senate.
